Terms of Service

1. Scope and Provider

These Terms of Service govern the use of the online platform "Seeyoo Magic" (the "Service") and the associated services. The provider is:

By registering or using the Service, you accept these Terms of Service.

2. Service Description

Seeyoo Magic is an AI-powered service for processing photos. With the Service you can, among other things:

• turn static photos into short video animations,
• enhance photos (sharpening, colorization, upscaling),
• create slideshows from multiple photos,
• compile videos from photos.

Image processing is performed using cloud-based AI models from our partners.

3. Registration and User Account

• Use of the Service requires a free user account.
• You must be at least 16 years old to use the Service.
• You must provide truthful information when registering.
• Only one account is allowed per person.
• You are responsible for keeping your access credentials confidential. If you suspect misuse, please notify us immediately.

4. Credits and Payments

4.1 Credit System

Paid features are billed via "Credits". You can purchase credit packages within the Service. The price per credit is shown transparently before purchase.

4.2 Payment Processing

Payments are processed via our payment service provider Stripe. By making a purchase you agree to Stripe's terms and conditions.

4.3 Delivery

Purchased credits are credited to your account immediately upon successful payment.

4.5 Validity and Refunds

Credits are non-transferable and cannot be paid out in cash. Refunds are only made in cases provided by law (e.g. permanent unavailability of the service).

5. User Content

5.1 Ownership and License

You remain the owner of all rights in photos and content you upload ("User Content"). You only grant us a worldwide, royalty-free license, limited in time to the term of the contract, to store, process and transform your content via AI services from our partners, to the extent necessary to provide the service.

5.2 Warranties

You warrant that:

• you own all necessary rights in the uploaded content,
• the content does not infringe third-party rights (copyright, trademark, personality rights),
• persons depicted have consented to the processing where required.

5.3 Prohibited Content

The following content is prohibited:

• pornographic, sexually explicit or child-sexual-abuse material,
• content with extreme violence, hate speech or unconstitutional symbols,
• images of third parties without their consent,
• content intended to deceive (deepfakes of real persons without consent, defamatory content, etc.),
• images of identification documents, payment cards, or other sensitive documents.

We reserve the right to delete content without prior notice and to suspend the affected accounts.

5.4 Editing photos of other people

If you use the “Customization” feature to edit photos showing other people, you are solely responsible for obtaining the explicit consent of those people before publishing or sharing the edited image.

This applies in particular to publication on social networks, messaging services, websites, or any other publicly accessible media. Publishing an edited image of a person without their consent may violate personality rights, data-protection laws (in particular GDPR Art. 6 / Art. 9), and depending on the content may be a criminal offence.

Seeyoo Magic accepts no liability for unlawful publications carried out by users. You agree to indemnify Seeyoo Magic against any third-party claims arising from such publications.

6. Availability

We aim for the highest possible availability of the Service but do not guarantee uninterrupted use. Maintenance, technical failures or force majeure may cause temporary restrictions.

7. Intellectual Property in the Service

All rights in the Service, its source code, design, logos and trademarks belong to Seeyoo IT Solutions GmbH or its licensors. Reproduction, modification or redistribution requires our express consent.

8. Liability

We are liable without limitation for intent and gross negligence as well as for injuries to life, body or health. For ordinary negligence we are liable only for breach of essential contractual obligations and limited to foreseeable, contract-typical damage.

Any further liability is excluded. In particular, we accept no liability for the quality, accuracy or fitness of AI-generated results.

9. Termination and Account Deletion

You can terminate your account at any time via the "Delete account" function. We may terminate the contract with reasonable notice or immediately suspend it in case of serious violations of these Terms.

10. Data Protection

The handling of personal data is governed by our Privacy Policy.

11. Changes to These Terms

We may update these Terms when this becomes necessary for legal or technical reasons or when new features are introduced. Changes will be communicated to you in good time (at least 30 days in advance) by email or on the platform. If you do not object within this period, the amended Terms shall be deemed accepted.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where you are a consumer, mandatory consumer protection provisions of your country of habitual residence remain unaffected.
• If any provision of these Terms is invalid, the validity of the remaining provisions remains unaffected.
• Place of performance and venue for merchants is Bad Oeynhausen, Germany.
